Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Hogue Cinematics LLC, Toledo, OH.
Service refers to the Website as well as Physical Services provided by this company.
Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
Website refers to Hogue Cinematics, accessible from https://www.hoguecinematics.com/
You (referred to as either "You" or "Your" in this Agreement) means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Cancellation

Requests to cancel a service must be made at least 24 hours prior to the initial scheduled date. Failure to cancel before this period prohibits You from booking with Hogue Cinematics for a period of 30 days. Deposits will only be refunded if Your cancellation request is made within 14 days after Your purchase date. After 14 days no refund will be granted.

Rescheduling
Requests to reschedule a Service must be made at least 24 hours prior to the initial scheduled date. Failure to reschedule a Service before this period prohibits You from booking with Hogue Cinematics for a period of 30 days. A Service will only be rescheduled one time free of charge. After the first reschedule, a $25 fee will be charged for any additional rescheduling.

Payment
Deposits are to be paid in full upon booking a Service. Remaining balance is to be paid upon the completion of Our Services. Until Your remaining balance is paid, no video/photo content will be sent or published. No new bookings/deposits will be accepted from you. Overdue balances will result in late fees; adding $100/month for 6 months. If Your overdue balance exceeds 6 months, Your excess files will be deleted, and no refund will be granted. Until the overdue balance is paid, You will no longer be able to book with Hogue Cinematics. No refund will be granted after a service has been completed.

Revisions
All revision requests are to be made within 48 hours post-product completion. Free revisions will only be permitted within this 48 hour period. Any revision(s) requested outside of this 48 hour period will cost an additional charge. Prices for the additional revisions may vary.

Liability

You are liable for financially providing for your own production needs such as: set location, wardrobe, props, ideas, etc. If You have booked the Creative Planning Consultation, Hogue Cinematics is liable only for providing, (non-financially), the production plans. Under any circumstance, Hogue Cinematics has no liability over You, aside from providing Our videography/photography Services.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new Terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised Terms. If You do not agree to the new Terms, in whole or in part, please stop using the Website and the Service.
